Terms of Service

These terms are an agreement between you and Orchard Neuro, PBC ("Orchard," "we") covering this website, our waitlist, and founding reservations. By using the site or signing up, you agree to them. The clinical service itself (the Orchard Profile) is additionally governed by the consent and service documents you sign at intake.
1. What Orchard is, and is not
The Orchard Profile is clinical decision support: a structured, clinician-led assessment delivered as a report that informs decisions made by you and your licensed clinician. Orchard, this website, and all of its content:
- do not provide medical advice, diagnosis, or treatment;
- do not create a clinician–patient relationship through this website, the waitlist, a reservation, or our emails;
- are not a substitute for care from a licensed professional; and
- are not an emergency service. If you are in crisis or considering harming yourself, call or text 988 (US) or call 911.
All treatment decisions are made by you and your licensed clinician.
2. Who may use this
You must be 18 or older and located in the United States. The waitlist is open nationwide; the Profile itself is offered state by state as availability opens, and a reservation does not guarantee availability in your state (see the Refund Policy for what happens if we can't serve you).
3. Waitlist and reservations
- Joining the waitlist is free and creates no obligation on either side.
- A founding reservation holds your place with a refundable deposit and locks your founding price, all on the terms of our Refund Policy, which is part of these terms.
- Founding pricing is limited (currently to the first 500 Profiles) and offered while spots remain; your locked price is honored per the Refund Policy.
- Reservations are one per person and non-transferable. We may decline or cancel a reservation (with a full refund) where we cannot lawfully or safely provide the service.
4. Payments
Payments are processed by Stripe under its own terms. Prices are stated at checkout; the amount you'll owe beyond your deposit is shown before you pay anything. Taxes, where applicable, are added at checkout.
5. Your account and communications
We use email links rather than passwords. You're responsible for keeping access to your email secure and for the accuracy of the information you give us. By signing up you consent to receive the emails described at signup; unsubscribe any time. Text messages are sent only if you separately opt in, and STOP always works.
6. Acceptable use
Don't misuse the site: no unlawful use, no scraping or harvesting of data, no attempting to breach security, no impersonation, no interfering with others' use. We may suspend access for violations.
7. Content and intellectual property
The site, its content, and the Orchard name and marks are ours or our licensors' and are protected by law. We grant you a personal, non-transferable license to use the site as intended. Your own report, when you receive one, is yours to keep and share as you choose. If you send us feedback or suggestions, we may use them without obligation.
8. Third-party services and links
The site relies on third-party providers (such as Stripe for payments) and may link to resources we don't control. We're not responsible for third parties' content or practices.
9. Disclaimers
The website and waitlist are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, regarding the website, waitlist, and reservations. Nothing in this section limits the commitments we make in the Refund Policy or the terms of the clinical service documents you sign at intake.
10. Limitation of liability
To the fullest extent permitted by law, Orchard's total liability arising out of the website, waitlist, or a reservation is limited to the greater of the amounts you have paid us in the twelve months before the claim or one hundred dollars ($100), and neither party is liable for indirect, incidental, special, consequential, or punitive damages. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot lawfully be limited.
11. Indemnity
You agree to indemnify Orchard against claims arising from your violation of these terms or misuse of the site, to the extent permitted by law.
12. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, both sides agree to try in good faith to resolve the dispute informally by emailing legal@orchardneuro.co and allowing 30 days. Any claim not resolved informally will be brought in the state or federal courts located in San Francisco, California, and both sides consent to their jurisdiction.
13. Changes, termination, and the rest
We may update these terms; material changes will be announced by email or on the site before they take effect, and continued use after that constitutes acceptance. We may discontinue the waitlist or reservations at any time, in which case the Refund Policy governs anything you've paid. If any provision is unenforceable, the rest remain in effect. These terms plus the Refund Policy and Privacy Policy are the entire agreement about the website and waitlist. Failure to enforce a provision is not a waiver.
